Terms of Use

1. Acceptance of Terms

By downloading, installing, or using any application or service provided by ApexWave Core S.R.L. ("ApexWave", "we", "us"), including but not limited to AntiChat, ApexSoul, ApexHealth, and ApexIDE, you agree to be bound by these Terms of Use. If you do not agree, do not use our services.

2. Description of Services

ApexWave develops and operates software applications for communication, personal AI assistance, health tracking, and development tools. Features and availability may vary by product and subscription tier.

3. Account Registration

Some services require account creation. You are responsible for:

• Providing accurate account information
• Maintaining the security of your credentials
• All activity that occurs under your account

You must be at least 13 years old (or 16 in the EU) to create an account.

4. Subscriptions and Payments

App Store Subscriptions

• Subscriptions purchased through the Apple App Store are governed by Apple's terms
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions

Web Subscriptions

• Web-based subscriptions are processed through Stripe
• Subscriptions renew automatically at the end of each billing period
• You may cancel at any time through your account settings
• Cancellation takes effect at the end of the current billing period

Refunds

• App Store purchases: refunds are handled by Apple per their refund policy
• Web purchases: contact us within 14 days of purchase for a refund if you're unsatisfied

Free Trials

Some products offer free trial periods. If you do not cancel before the trial ends, your subscription will begin and you will be charged. Trial eligibility is determined by Apple or our payment processor and is limited to one trial per user.

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Transmit malware, spam, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse-engineer, decompile, or disassemble our software (except where permitted by law)
• Use our services to harass, abuse, or harm others
• Circumvent subscription or access restrictions
• Use automated systems to access our services without permission

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

All content, code, design, trademarks, and intellectual property in our applications are owned by ApexWave Core S.R.L. or licensed to us. You receive a limited, non-exclusive, non-transferable license to use our software for personal or business purposes in accordance with these terms.

7. User Content

You retain ownership of any content you create or provide through our services. By using our services, you grant us a limited license to process your content solely for the purpose of providing the service (e.g., storing your preferences, processing your requests).

8. Apple EULA

For apps distributed through the Apple App Store, these terms supplement Apple's standard Licensed Application End User License Agreement (EULA). In the event of a conflict between these terms and Apple's EULA, Apple's EULA shall prevail for App Store-related matters.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or secure. You use our services at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ApexWave Core S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our services.

Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless ApexWave Core S.R.L. from any claims, damages, or expenses (including legal fees) arising from your use of our services or violation of these terms.

12. Termination

We may suspend or terminate your access to our services at any time for violation of these terms. You may stop using our services at any time. Upon termination:

• Your license to use our software is revoked
• Active subscriptions should be cancelled through the respective platform
• We may delete your account data after a reasonable period

13. Governing Law

These terms are governed by and construed in accordance with the laws of Romania. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.

For EU consumers: nothing in these terms affects your statutory rights under applicable consumer protection laws.

14. Changes to These Terms

We may modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify you.
